Find A Table

1. Introduction and ScopeThe Platform accessible at www.findatable.nl, connect.findatable.nl, and via the Find A Table iOS and Android applications (hereinafter the “Platform”) is the property of New Soft Solution, trading as Find A Table (hereinafter “Find A Table”, “we”, “us”, or “our”), registered in the Netherlands under KvK 95603840, with registered address at Fluitekruidweg 257, 1508 AG Zaandam, Netherlands, BTW NL005166191B43.
By accessing or using the Platform, you (“User”, “you”, or “your”) acknowledge having read these Terms & Conditions (“Terms”) and agree to comply with them. If you do not agree, you must not use the Platform.
2. Definitions
- “Platform” means the Find A Table website (www.findatable.nl), the restaurant administration dashboard (connect.findatable.nl), the iOS and Android mobile applications (guest applications, administrative dashboards, POS systems, and related software), any reservation widgets embedded on third-party websites, and all related services.
- “Restaurant Partner” means a restaurant, café, or food-service establishment that has subscribed to Find A Table services and is listed on the Platform.
- “Reservation” means a table booking made through the Platform.
- “Order” means a food order for delivery or pickup placed through the Platform.
- “Gift Card” means a prepaid digital voucher purchased on the Platform, redeemable at a specific restaurant.
- “Loyalty Programme” means the Find A Table points-based reward system.
- “POS” or “Point of Sale” means the Find A Table restaurant management software provided as a service, including mobile and tablet applications, used by Restaurant Partners to manage orders, payments, reservations, inventory, staff, and other operational activities.
3. Purpose
These Terms define the conditions of access to and use of the Platform, the services offered, and the content published on the Platform.
Find A Table is an online platform that helps people discover restaurants, book tables, order food for delivery or pickup, share dining experiences through reviews, and participate in a loyalty programme. We also offer gift cards for frequent diners. Guests can access the Platform via our full-featured iOS and Android mobile applications. For restaurant owners, we provide listing tools, a fully customisable management dashboard (accessible at connect.findatable.nl), and an optional point-of-sale (POS) system available on both iOS and Android for mobile and tablet devices.
Find A Table acts as an intermediary. The contractual relationship for the supply of food and hospitality services is between you and the Restaurant Partner. We are not a party to that contract and do not assume liability for the Restaurant Partner’s performance.
4. Use of the Platform
4.1 Access
The Platform can be accessed freely by any user with internet access. Costs pertaining to accessing the Platform (equipment, software, internet connection) are exclusively borne by the user. You are solely responsible for the proper functioning of your IT equipment and internet access.
Certain features (making reservations, placing orders, participating in the loyalty programme) require you to create a Find A Table account. You must be at least 18 years of age to create an account and use the Platform.
4.2 Security
Find A Table makes its best efforts, in accordance with industry standards, to secure the Platform. However, we cannot guarantee absolute security of the Platform or the internet in general.
You must take appropriate measures to ensure the security of your own data and devices, including protection against viruses, malware, and other harmful technologies. You undertake not to commit any act that could endanger the IT security of the Platform, and you should not introduce any viruses, malicious code, or other harmful technology to the Platform.
You accept the inherent characteristics and limitations of the internet and acknowledge that data transmitted electronically is not guaranteed against all forms of misuse.
4.3 Prohibited conduct
You agree not to:
• Use the Platform for any unlawful purpose or in violation of these Terms;
• Impersonate another person or misrepresent your affiliation with any entity;
• Attempt to gain unauthorised access to any part of the Platform or its underlying systems;
• Download, collect, copy, alter, modify, distribute, transmit, rent, sell, or exploit Platform content, whether fully or partially, without our prior written consent;
• Use any method to access the Platform other than the interface provided by Find A Table;
• Use devices, software, robots, crawlers, spiders, scrapers, scripts, or automated systems that may disturb, disrupt, or place a disproportionate load on the Platform’s infrastructure;
• Extract, scrape, screen-scrape, or systematically harvest data from the Platform by any means;
• Submit false reviews, fake reservations, or fraudulent orders;
• Use the Platform to send unsolicited commercial communications;
• Interfere with the proper functioning or availability of the Platform.
Find A Table reserves the right to initiate any necessary action, including legal proceedings, to prevent, terminate, and penalise any breach of these prohibitions, without prior formal notice.
4.4 Links
You may not establish a link to the Platform without Find A Table’s express and prior authorisation, requested by email to support@findatable.nl. Such authorisation does not constitute an affiliation agreement and may be revoked at any time.
The Platform may contain links to third-party websites. We have no control over these sites, their content, or their data-protection practices. We are not liable for damage resulting from your use of third-party websites linked from the Platform.
4.5 Availability
Find A Table makes its best efforts to ensure the Platform is accessible 24/7. However, due to the nature of the internet, full availability cannot be guaranteed. We may, without prior notice or compensation:
• Temporarily or permanently close all or part of the Platform to perform updates, maintenance, or security patches;
• Modify, add, or remove features at any time.
4.6 Content quality
Content on the Platform (restaurant listings, menus, pricing, images) is provided by Restaurant Partners and/or for general information purposes. Despite care taken in curating the Platform, content is provided “as is” and Find A Table cannot guarantee its accuracy, completeness, or suitability for your specific requirements. Restaurant menus, pricing, delivery areas, and availability are set exclusively by each Restaurant Partner.
5. Your Account
When creating and using your account, you agree to:
• Provide accurate, complete, and current information;
• Keep your login credentials confidential and not share them with others;
• Notify us immediately if you suspect unauthorised use of your account;
• Accept responsibility for all activity under your account.
We reserve the right to suspend or terminate accounts that violate these Terms, contain false information, or are used for fraudulent purposes, after providing reasonable notice where practicable. In cases of fraud, illegal activity, or severe abuse, we may terminate access immediately.
6. Reservations
When you make a reservation through the Platform, you enter into a direct agreement with the Restaurant Partner. By confirming a reservation, you agree to:
• Arrive at the stated time or cancel in advance through the Platform;
• Comply with the Restaurant Partner’s own house rules and cancellation policy;
• Provide accurate party-size and contact information.
Find A Table does not guarantee the availability of a table, the quality of food or service, or compliance with dietary-requirement requests. These are the responsibilities of the Restaurant Partner.
If you fail to show up without cancelling (“no-show”), this may be noted on your account. Repeated no-shows may result in account restrictions or the Restaurant Partner requesting prepayment or card pre-authorisation for future bookings.
7. Delivery and Pickup Orders
Where available, you may place food orders for delivery or pickup. Each Restaurant Partner sets its own delivery area, menu, and pricing. If your address falls outside the Restaurant Partner’s delivery zone, the order cannot be completed. All orders require upfront payment via credit card (Visa/Mastercard) or iDEAL. The contract for the supply of food is between you and the Restaurant Partner.
Find A Table charges the Restaurant Partner a 1% platform commission on the total value of each online order (delivery or pickup), plus 21% BTW on that commission, and a €0.29 per-transaction fee to cover third-party payment processing costs (Stripe). These charges are borne by the Restaurant Partner, not the guest. Delivery fees, if any, are set entirely by the Restaurant Partner and are separate from Find A Table’s commission.
Once an order is confirmed by the Restaurant Partner, cancellation may not be possible. Refund requests for food quality, missing items, or incorrect orders should be directed to the Restaurant Partner first. If unresolved, contact support@findatable.nl and we will assist in mediating.
8. Gift Cards
Key terms for digital gift cards:
• Valid for 24 months from the date of purchase, in accordance with Dutch law;
• Non-refundable and cannot be exchanged for cash;
• Redeemable only at the specific Restaurant Partner for which they were purchased and that is listed on the Platform;
• Remaining balance after partial use stays on the card until expiry;
• Find A Table deducts a 10% service fee plus 21% BTW on that fee from the card value before settlement with the Restaurant Partner.
Customers (guests) do not pay any fees to Find A Table when purchasing or redeeming a Gift Card; all applicable service fees are charged to the Restaurant Partner.
If a Restaurant Partner permanently closes, Find A Table will make reasonable efforts to facilitate a refund or transfer of the gift card balance, but cannot guarantee this.
9. Loyalty Programme
The Find A Table loyalty programme rewards guests with points:
• +300 points on initial account sign-up;
• +200 points per completed reservation (honoured visit);
• +200 points for writing a review after your visit;
• +100 points per successful referral.
Reviews must be linked to a completed reservation and comply with our content guidelines. Share your experience and help others discover great restaurants.
1,000 points can be redeemed for a €10 voucher, valid for 30 days, applicable to bills of €50 or more. Points and vouchers have no cash value and are non-transferable. We reserve the right to modify programme rules with 30 days’ advance notice.
10. Payments and Pricing
All payments on the Platform are processed by Stripe (Stripe Payments Europe, Ltd., Dublin, Ireland). By making a payment, you agree to Stripe’s terms of service. Find A Table does not store your full payment card details.
Prices displayed on the Platform are set by Restaurant Partners and include BTW/VAT where applicable. Find A Table is not responsible for pricing errors by Restaurant Partners. If a payment fails or is reversed, the associated reservation or order may be cancelled.
11. User Content and Reviews
You may post reviews, ratings, and feedback about Restaurant Partners on the Platform. By posting content, you:
• Grant Find A Table a non-exclusive, royalty-free, worldwide licence to display, reproduce, and distribute the content on the Platform and associated media;
• Confirm that the content is your own, is truthful, and does not infringe any third-party rights;
• Agree not to post content that is defamatory, discriminatory, threatening, obscene, or otherwise unlawful.
We reserve the right to remove content that violates these Terms or applicable law, without prior notice. You may delete your own reviews at any time through your account.
11.1 Digital Services Act (DSA)
In accordance with Regulation (EU) 2022/2065 (Digital Services Act):
• Users may report illegal or non-compliant content via the Platform or by contacting support@findatable.nl;
• Find A Table will review such reports promptly and take appropriate action;
• Users have the right to appeal content-moderation decisions;
• Decisions may include removal, restriction, or limitation of visibility of the content;
• Find A Table may publish transparency reports where required by law.
12. Intellectual Property
All content, design, logos, software, databases, and technology on the Platform are owned by or licensed to Find A Table and are protected by copyright, trademark, database rights, and other intellectual-property laws of the Netherlands, the European Union, and international treaties.
You may not copy, modify, distribute, or create derivative works of any Platform content without our prior written consent. Any total or partial reproduction, extraction, or reuse of the databases on the Platform is prohibited and penalised under applicable law.
The Find A Table name, logo, and associated branding are registered trademarks of New Soft Solution. All other trademarks, logos, and distinctive signs reproduced on the Platform are the property of their respective owners.
13. Limitation of Liability
To the maximum extent permitted by Dutch law:
• Find A Table provides the Platform “as is” and “as available” without warranties of any kind, whether express or implied;
• We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components;
• We are not liable for indirect, incidental, consequential, or punitive damages, including loss of revenue, data, reputation, or any damage arising from third-party claims;
• We are not liable for the temporary or permanent unavailability of all or part of the Platform, response-time issues, or any performance defects;
• We are not liable for the consequences of inaccurate, incomplete, or outdated information provided by you or by Restaurant Partners;
• We are not liable for decisions you make based on content published on the Platform;
• Our total aggregate liability shall not exceed the greater of (a) €100 or (b) the fees you have paid to us in the 12 months preceding the claim.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under Dutch law.
14. Indemnification
You agree to indemnify, defend, and hold harmless Find A Table, its directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Platform, your violation of these Terms, or your infringement of any third-party rights.
15. Termination
You may stop using the Platform and delete your account at any time through your account settings or by contacting support@findatable.nl.
We may suspend or terminate your access if you materially breach these Terms, after providing notice and a reasonable opportunity to remedy (where capable of remedy). In cases of fraud, illegal activity, or severe abuse, we may terminate access immediately without notice.
Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination (liability, indemnification, intellectual property, dispute resolution) will continue to apply.
16. Personal Data and Cookies
Personal data may be processed via the Platform. Please consult our Privacy & Data Protection Policy for full details on how we collect, process, and protect your personal data.
Cookies and similar technologies may be placed on your device when you use the Platform. Please consult our Cookie Policy for full details, including the types of cookies used, their purposes, and how to manage your preferences.
Both policies are accessible via the footer of all pages on the Platform.
17. Governing Law and Dispute Resolution
These Terms are drafted in English. In the event of any conflict between the English version and any translated version, the English version shall prevail.
These Terms are governed by and construed in accordance with the laws of the Netherlands.
If you are a consumer, you retain any mandatory consumer protections available under the laws of your country of habitual residence.
We encourage you to contact us first at support@findatable.nl to resolve any disputes informally. If a dispute cannot be resolved informally, it may be submitted to the competent court in Amsterdam, the Netherlands. As a consumer within the EU, you may also use the European Commission’s Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.
These provisions regarding applicable law and competent courts are subject to (i) public-order provisions and (ii) mandatory consumer-protection provisions applicable to you.
18. Modification and Updates
We reserve the right to modify these Terms at any time. We will notify you of material changes by email (if you have an account) and by posting a notice on the Platform at least 14 days before the changes take effect.
If you do not agree with the proposed changes, you may terminate your use of the Platform and delete your account via your account settings before the effective date. If you do not terminate before the effective date, you will be deemed to have accepted the changes. We will expressly inform you of this in the notification.
Your use of the Platform is governed by the version of the Terms in force at the time the agreement was concluded, or any subsequent version established in accordance with the procedure above. The current version always remains accessible and downloadable on the Platform.
We invite you to consult these Terms regularly.
19. Miscellaneous
If any provision of these Terms is found to be void, unenforceable, or inapplicable, the remaining provisions continue in full force. Our failure to invoke any provision shall not be interpreted as a waiver of the right to do so later.
These Terms, together with our Privacy & Data Protection Policy and Cookie Policy, constitute the entire agreement between you and Find A Table regarding your use of the Platform as a guest.
